Terms of Service
These Terms of Service ("Terms") govern your access to and use of PrimeReports.ai ("PrimeReports", "we", "us", or "our"), including the website, mobile application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least eighteen (18) years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
PrimeReports is an AI-powered home inspection platform designed for use by Texas Real Estate Commission (TREC)-licensed home inspectors. The Service allows inspectors to capture photos and videos during inspections, generate TREC REI 7-6 compliant inspection reports using artificial intelligence, and deliver those reports to clients and agencies.
3. Account Registration
To access the Service you must register an account. You agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account.
Inspectors must hold a valid Texas TREC license. Companies and Agencies are responsible for verifying the licensure status of their inspectors.
4. Inspector Responsibility for Reports
All TREC REI 7-6 reports generated through the Service are issued under the inspecting individual's TREC license. The inspector is solely responsible for the accuracy and completeness of every report bearing their license. AI-generated content is provided as a drafting aid only; the inspector must review and approve all findings before the final report is generated.
5. Fees and Payment
Use of the Service is billed on a per-inspection basis. The default fee is $49.00 per generated report unless a custom rate has been agreed upon. Payment is processed by Stripe and is collected automatically when an inspection begins. Companies are responsible for maintaining a valid payment method on file. If a payment fails, the inspection cannot proceed until payment is resolved.
6. Free Reports
From time to time PrimeReports may issue free report credits to a Company. These credits have no cash value, are non-transferable, and may expire at our discretion.
7. Acceptable Use
You agree not to use the Service to:
- Violate any law, regulation, or third-party right;
- Submit false, misleading, or fraudulent inspection findings;
- Generate reports under another person's TREC license;
- Attempt to interfere with or disrupt the Service;
- Reverse-engineer, scrape, or copy any portion of the Service;
- Upload content that is unlawful, defamatory, or infringing.
8. Photo and Video Storage
Inspection photos, videos, and generated PDF reports are stored on our servers for thirty (30) days following report generation. After that period the source files are permanently deleted. Inspectors and companies are responsible for downloading and retaining their own copies. Reports are delivered as a downloadable archive containing the PDF and any associated video files.
9. Intellectual Property
The Service, including all software, designs, text, graphics, and trademarks, is the property of PrimeReports or its licensors. You retain all rights to the inspection content (photos, videos, reports) you create. By using the Service you grant PrimeReports a limited license to host, process, and deliver that content as necessary to provide the Service.
10. Third-Party Services
The Service relies on third-party providers including Stripe (payment processing) and Anthropic (AI analysis). Your use of the Service is also subject to those providers' terms of service. We are not responsible for the acts or omissions of third-party providers.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. PRIMEREPORTS MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE FREE OF MISTAKES. ALL REPORTS REMAIN THE PROFESSIONAL RESPONSIBILITY OF THE LICENSED INSPECTOR.
12. Limitation of Liability
To the maximum extent permitted by law, PrimeReports's total liability arising out of or relating to these Terms or the Service shall not exceed the fees you paid to us in the three (3) months preceding the claim. PrimeReports is not liable for indirect, incidental, special, consequential, or punitive damages.
13. Indemnification
You agree to indemnify and hold harmless PrimeReports from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
14. Termination
You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for other lawful reasons. Upon termination, access to the Service ends and stored files may be deleted.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted to this page with a new effective date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Texas.
